1. Who operates this Site

This Site is published by a licensed Kansas real estate salesperson under the supervision of Growth Ring Realty, the brokerage identified in the Site footer. “We,” “us,” and “our” refer to that agent and Growth Ring Realty.

2. Using this Site does not create a brokerage relationship

Reading these pages, submitting a form, saving information, or contacting us does not, by itself, create a brokerage relationship or make us your agent or representative.

Under Kansas law (the Brokerage Relationships in Real Estate Transactions Act), a brokerage relationship begins only with a written agreement. Until a written agreement is signed, we owe you only the duties that Kansas law requires us to owe a customer, not the higher duties owed to a client.

3. Disclaimer regarding information on this Site

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless Growth Ring Realty, the publishing agent, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another party.

11. Changes to these Terms

We may update these Terms from time to time. The version published on this page is the version that applies. Your continued use of the Site after any change constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

12. Governing law

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Kansas.
